Session Description:

This session will provide an overview of the information-blocking section of the 21st Century Cures Act, which was signed into law on December 13, 2016, and became effective on April 5, 2021. Participants will gain an understanding of how the Cures Act defines electronic health information and who is considered by the Cures Act to be an "actor". Auditors will learn about the eight exceptions to information blocking provided in the Cures Act and will hear real-life examples of implementing each of the exceptions. Participants will learn how internal audit can assist healthcare organizations in complying with the Cures Act and will explore the penalties for non-compliance. 

Learning Objectives:
Following this discussion, participants will be able to:
  1. Explain the importance of the Cures Act and how healthcare organizations can invoke the related information-blocking exceptions.
  2. Explain the difference between the two types of information-blocking exceptions.
  3. Discuss how auditors should work with the organization to help ensure compliance with the Cures Act.
  4. Discuss the penalties for non-compliance with the Cures Act.
